THE VAC-TRON LIMITED WARRANTY

Vac-Tron Equipment, LLC warrants each new unit to be free from defects in material and workmanship for a period of (2) years on parts and (1) year in labor from the date of purchase. This warranty is expressly made to the Original Purchaser.

Warranties do not extend to any unit or part thereof, which has been subjected to misuse neglect, accident, improper loading or hauling over and above the recommended weight range. This warranty does not extend to such units or parts which have been repaired or altered outside of our Factory or to which any accessories other than Vac-Tron Equipment, LLC have been affixed, or to any unit or part not repaired by an authorized Vac-Tron Equipment, LLC Dealer or Distributor. Vac-Tron Equipment, LLC obligation under this warranty is limited to replacement or repair of any part or parts thereof, which within the warranty period shall be returned to our Factory, Okahumpka, Florida, transportation charges pre-paid, for inspection. If such inspection reveals that a defect in the material or manufacturing actually exists, then Vac-Tron Equipment, LLC at its option, may repair or replace the defective part/s. All items not manufactured by Vac-Tron Equipment, LLC are subject to the original manufacturer’s warranty.

This warranty is not valid until the warranty validation certificate form, (which is attached and provided at the time of the purchase) is completed by the purchaser and returned to Vac-Tron Equipment, LLC. Vac-Tron Equipment, LLC does not assign to any of its Dealers, Distributors or Agents the right of warranty on its behalf. If said Dealer or Distributor in performing a service or repair to our Factory on behalf of the purchaser such unit or part/s, the existence, validity or applicability of this warranty regarding such unit or part/s remains solely the prerogative of VacTron Equipment, LLC and not its aforementioned Agents.

LIMITATION OF REMEDY

The remedies provided herein shall be the sole and exclusive remedies available to buyer, its heirs, successors and assigns. If such limitation is unenforceable, the notwithstanding anything herein to the contrary, the maximum damages for which Vac-Tron Equipment, LLC may or shall be liable shall be the sales price for the part, component or assembly, claimed to be defective. Vac-Tron Equipment, LLC shall not be liable for consequential damages including loss of profits, personal injury or death, property damages or any other commercial loss arising out of any claimed failure or defect of the Vac-Tron Equipment, LLC product/s.

EXCLUSIVE AND SOLE WARRANTY

The warranty provided herein is the sole and only warranty and there is no warranty of merchantability, fitness for a particular purpose, warranty arising from a course of dealing or usage of trade or any other implied or expressed warranty except made specifically provided herein.

Use of the unit for purposes not recommended is at the purchaser’s own risk. Any use of the unit for a purpose or in a manner contrary to the recommendations set forth above in these paragraphs shall void the provisions of the warranty.
